Welcome to YOUIN? APP INC. (“YouIn?”, “we”, “us”, “our”). These terms and conditions (“Terms”) govern your use of our platform and services (“Platform”). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our Platform.
By accessing or using our Platform, you agree to comply with these Terms, as well as our Privacy Policy, which is incorporated by reference. We may update these Terms at any time, and your continued use of the Platform after any changes signifies your acceptance of the updated Terms.
YouIn? provides a digital platform designed to assist union organizers in organizing their workplace drives. You agree to use the Platform solely for its intended purpose and in compliance with all applicable laws and regulations. Unauthorized use of the Platform is strictly prohibited.
To access certain features of our Platform, you must create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account.
By creating an account on our Platform, you consent to receive electronic communications from us and our union partners. You acknowledge the inherent risks associated with electronic communication and agree to bear such risks.
All content and materials on the YouIn? Platform, including but not limited to text, graphics, logos, and software, are the property of YouIn? and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
By submitting content to our Platform, you grant YouIn? a non-exclusive, perpetual, irrevocable, royalty-free license to use, modify, and distribute your content in connection with the Platform. You warrant that you have the rights to grant such a license.
You agree not to engage in any of the following activities while using the Platform:
Unions may cancel their subscription at any time by providing written notice. Upon cancellation, access to the Platform will be terminated immediately. YouIn? reserves the right to terminate or suspend any user’s access to the Platform at any time, with or without cause, and without prior notice.
9.1. Platform Exclusivity or Acquisition
In the event that a union or any other entity offers platform exclusivity or seeks to acquire the platform, YouIn? reserves the right to cancel or modify any ongoing monthly subscriptions, service agreements, or access to the platform at our sole discretion. Users will be provided with notice of such changes, and any cancellations will take effect immediately or as specified in the notice.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUIN? SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
We may amend these Terms at any time. Any amendments will be effective immediately upon posting on the Platform. It is your responsibility to review the Terms regularly. Continued use of the Platform after any amendments constitutes your acceptance of the revised Terms.
Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of the province or state in which you reside and the federal laws of Canada or the United States, as applicable. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in your province, state, or federal district, as applicable.
These Terms, along with our Privacy Policy and any other legal notices published by YouIn? on the Platform, constitute the entire agreement between you and YouIn? regarding your use of the Platform
